1. Introduction

Welcome to Leftover Lab. These Terms of Service ("Terms") govern your use of our AI-powered recipe generation website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

2. Definitions

  • "Service" refers to the Leftover Lab website, mobile application, AI-powered recipe generation service, ingredient recognition technology, subscription platform, and all related features, functionality, and services provided by Leftover Lab.
  • "User" refers to any individual who accesses, uses, or interacts with our Service, whether as a registered user, subscriber, or visitor.
  • "Company" refers to Leftover Lab.
  • "Content" refers to all information, data, text, software, images, graphics, recipes, videos, messages, or other materials available through or generated by the Service, including AI-generated content and User Content.

3. Use of Service

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18, you may only use the Service with parental consent and supervision.

You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable laws and regulations. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation, including but not limited to intellectual property, privacy, food safety, or consumer protection laws.
  • To upload, transmit, or distribute any material that contains viruses, malware, spam, or any other harmful, disruptive, or malicious code or content.
  • To impersonate or attempt to impersonate Leftover Lab, our employees, other users, or any other person or entity, or to misrepresent your affiliation with any person or entity.
  • To engage in any conduct that restricts, inhibits, or interferes with anyone's use of the Service, or to attempt to circumvent, disable, or otherwise interfere with security features or functionality of the Service.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. You agree to update your information as necessary to maintain its accuracy. Providing false or misleading information constitutes a breach of these Terms and may result in immediate termination of your account.

You are responsible for safeguarding the password and any other credentials you use to access the Service and for all activities or actions that occur under your account. You must use a strong, unique password and enable any available security features. We encourage you to log out from your account at the end of each session.

You agree not to share your account credentials with any third party or allow others to access your account. Each account is personal and non-transferable. You must notify us immediately upon becoming aware of any breach of security, unauthorized use of your account, or any other security concern.

5. User Content

Our Service allows you to upload images of ingredients, save recipes, and share content ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

You are solely responsible for all User Content that you upload, post, or share through the Service, including its legality, reliability, appropriateness, and compliance with applicable laws. You represent and warrant that:

  • You own or have obtained all necessary licenses, rights, consents, and permissions to use and authorize us to use your User Content as described in these Terms.
  • Your User Content does not violate or infringe upon the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
  • Your User Content complies with these Terms and all applicable laws and regulations, including but not limited to food safety, intellectual property, and privacy laws.

6. AI-Generated Content

The recipes and other content generated through our AI services powered by OpenAI are provided for informational and educational purposes only. While we use advanced AI technology to generate recipes based on your ingredients and preferences, we make no guarantees regarding the accuracy, reliability, safety, nutritional value, or suitability for any particular purpose of AI-generated content. AI-generated recipes should not be considered professional culinary or nutritional advice.

By using our AI-powered features, you acknowledge and agree that:

  • AI-generated recipes should be followed with caution, common sense, and your own judgment regarding food safety, dietary restrictions, and cooking techniques.
  • You are solely responsible for verifying ingredient safety, checking for allergens, ensuring proper food handling and preparation methods, and determining the suitability of any recipe for your dietary needs, restrictions, and health conditions.
  • We are not responsible for any adverse effects, allergic reactions, food poisoning, illness, injury, or other consequences resulting from following or attempting to follow AI-generated recipes or recommendations.

7. Intellectual Property

The Service and its original content (excluding User Content), features, functionality, AI models, algorithms, software, design, and related intellectual property are and will remain the exclusive property of Leftover Lab and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of the United States and other countries.

Our trademarks, service marks, logos, trade names, and trade dress may not be used in connection with any product or service without our prior written consent. Any unauthorized use is strictly prohibited and may violate trademark, copyright, and other intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEFTOVER LAB, NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AFFILIATES, OR LICENSORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Service;
  • Any conduct, content, or services of any third party, including but not limited to OpenAI, Stripe, or other service providers;
  • Any content obtained from the Service, including AI-generated recipes and recommendations;
  • Unauthorized access, use, modification, or deletion of your transmissions, content, or account; and any errors, bugs, viruses, or other harmful components in the Service.

9. Disclaimer

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.

Leftover Lab does not warrant that the Service will function uninterrupted, secure, or be available at any particular time or location, that any errors or defects will be corrected, or that the Service is free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, violate applicable laws, engage in fraudulent activities, or pose a security risk. We may also terminate accounts that remain inactive for extended periods.

Upon termination, your right to use the Service will immediately cease, and we may delete your account and associated data in accordance with our data retention policies. If you wish to terminate your account, you may do so through your account settings or by contacting us. For Pro subscribers, account deletion may be scheduled for the end of your current billing period to ensure you receive the full benefit of your subscription.

11. Subscriptions and Payments

We offer both free and paid subscription plans (Pro). Free plans include limited usage (3 researches per week, 3 images per week, 5 saved recipes maximum). Pro plans offer unlimited usage and access to all features for a monthly or annual fee.

Pro subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We use Stripe for payment processing, and you agree to Stripe's terms of service.

New Pro subscribers may be eligible for a free trial period. Each user is limited to one trial per lifetime. Trials automatically convert to paid subscriptions unless canceled before the trial end date.

You may cancel your Pro subscription at any time through your account settings or by contacting us. Cancellation will be effective at the end of your current billing period. You will retain Pro features until the end of the paid period.

We reserve the right to change subscription prices at any time. We will provide advance notice of price changes, and continued use of the Service after the effective date constitutes acceptance of the new pricing.

12. Third-Party Services

Our Service integrates with third-party services including OpenAI for AI processing, Stripe for payments, Google Analytics for website analytics, and Cloudflare for infrastructure and security. Your use of these services through our platform is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, functionality, or practices of third-party services. Any issues with third-party services should be directed to the respective service provider.

When you use our Service, certain data may be shared with third-party services as described in our Privacy Policy. You consent to such data sharing as necessary for the operation of our Service.

13. Fair Use and Rate Limiting

To ensure fair access for all users, we implement usage limits and rate limiting. Free users are limited to 3 researches per week and 3 images per week. Excessive use that degrades service performance may result in temporary restrictions or account suspension.

We strive to maintain high availability but do not guarantee uninterrupted service. Planned maintenance, security updates, or high demand may temporarily affect service availability.

You may not use automated tools, scripts, or bots to access the Service excessively or circumvent usage limits. Such activity may result in immediate account termination.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where Leftover Lab operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, provided that we may seek injunctive relief in any jurisdiction.

15. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of material changes by posting the updated Terms on our website, updating the "Last Updated" date, and may notify you via email or through the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
